PAIA Manual (Section 51)
Last updated: 6 September 2026 · Version 1.0
This manual is published by Kompliant, a South African sole proprietorship carried on by
<Owner's full name>, in terms of
section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA).
It explains the records we hold and how you can request access to them.
PAIA gives everyone the right to access records held by private bodies, subject to the ground for
refusal in the Act. POPIA and PAIA work together: PAIA controls access to records, while
POPIA protects personal information. We aim to disclose as much as the law allows.

5. How to request access (form 2)
- Complete the prescribed request for access to records of a private body (Form 2).
- Provide enough detail for us to identify the record(s).
- Pay the prescribed request fee (if any) at our offices in cash or by EFT, or enclose proof of payment.
- Send the completed form with proof of identity via our contact form or the postal address above.
We respond within 30 days of receiving the request (PAIA s25), and may extend this
once by another 30 days with written notice. We will not process requests that are clearly
frivolous or vexatious (s45 – 46).
6. Fees
PAIA prescribes fees for access (a request fee and a reproduction fee, set by regulation). No fee
applies to making a request for your own personal information. Requests dealing with personal
information are handled under POPIA by our Information Officer at no charge.
7. Refusals and grounds for refusal
We may refuse access where the law requires or permits it, for example where disclosure would:
- unreasonably breach privacy protection under POPIA or PAIA s34;
- compromise commercial confidentiality (s36) or confidential third-party information;
- endanger the life or physical safety of an individual (s37);
- reveal privileged legal advice (s37 – 38).
If we refuse, we will give written reasons and your appeal/ internal remedies in line with PAIA and POPIA.
8. Internal remedies and appeals
Apply first to the Information Officer below; we will reconsider within the ordinary timeframes.
If unresolved, you may complain to the Information Regulator (inforegulator.org.za), which resolves
PAIA/POPIA disputes.
9. Reporting
As required by PAIA, the Information Officer submits the annual report for each reporting period
(1 April – 31 March) to the Information Regulator during the 1 April – 30 June window.
